Nattynooks Terms of Service

Welcome to Nattynooks. These Terms of Service ("Terms") govern your access to and use of the website located at https://nattynooks.com/ (the "Site") and any purchase of products made available through the Site. By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Company Information
The Site is operated by Nattynooks LLC ("Nattynooks," "we," "us," or "our"), a New York limited liability company with a registered address at 418 Broadway STE R, Albany, NY 12207.
2. Eligibility
You must be at least 18 years old to use the Site or make a purchase. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
3. Products and Orders
Nattynooks sells cotton ankle socks and related accessories ("Products") on a direct-to-consumer basis. Products are sold in single-pair and multi-pack bundles as described on the Site at the time of purchase. All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right, at any time, to: • modify or discontinue any Product; • limit the quantity of any Product available for purchase; and • refuse, cancel, or limit any order, including orders we believe were placed in error, that violate these Terms, or that we suspect involve fraudulent or unauthorized activity. At this time, Nattynooks ships only to addresses within the United States.
4. Third-Party Checkout
The Site is built and hosted independently of Shopify. However, all purchases are processed through Shopify's checkout system. By completing a purchase, you agree to Shopify's terms of service and policies governing the checkout and payment process, in addition to these Terms. Nattynooks remains responsible for our Products, pricing, and order fulfillment, but is not responsible for the operation of the Shopify checkout platform itself.
5. Accounts
Creating an account with Nattynooks is optional. If you choose to create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at contact@nattynooks.com if you become aware of any unauthorized access to or use of your account.
6. Returns, Refunds, and Shipping
Returns, refunds, and shipping terms, including our 60-day return window, are governed by our Shipping & Refund Policy (/shipping-refund-policy), which is incorporated into these Terms by reference. If there is any conflict between that policy and this section, the Shipping & Refund Policy controls for matters relating to returns, refunds, and shipping.
7. Intellectual Property
The Site, including its text, graphics, logos, product descriptions, and design, is owned by Nattynooks LLC or its licensors and is protected by applicable intellectual property laws. "NATTYNOOKS" is a trademark of Nattynooks LLC (U.S. Trademark Application Serial No. 99795168, International Class 25). You may not use, reproduce, or distribute any content from the Site, or any Nattynooks trademark, without our prior written permission.
8. Acceptable Use
You agree not to: • use the Site for any unlawful purpose or in violation of these Terms; • attempt to gain unauthorized access to the Site, its systems, or related networks; • interfere with or disrupt the operation of the Site; or • use any automated means to access or collect data from the Site without our prior written consent. We reserve the right to suspend or terminate your access to the Site for conduct that we believe violates these Terms or is harmful to Nattynooks, other users, or third parties.
9. Health and Wellness Information
The Site may include information regarding materials, certifications, and the potential benefits of reducing certain forms of daily contact exposure. This information is provided for general informational purposes only and is not, and should not be construed as, medical advice. Nattynooks Products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult a qualified healthcare provider with any questions regarding a medical condition.
10. Disclaimer of Warranties
The Site and all Products are provided "as is" and "as available," without warranties of any kind, whether express or implied, except as expressly stated in our Return & Refund Policy. To the fullest extent permitted by law, Nattynooks disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, Nattynooks LLC, its members, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any Product, even if advised of the possibility of such damages. Nattynooks' total liability for any claim arising from these Terms or any Product shall not exceed the amount you paid for the Product giving rise to the claim.
12. Indemnification
You agree to indemnify and hold Nattynooks LLC harmless from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any Product (a "Dispute") shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. You and Nattynooks each agree that any arbitration shall be conducted only on an individual basis and not as part of a class, consolidated, or representative action. If this waiver of class proceedings is found unenforceable as to a particular Dispute, that Dispute shall be resolved in the state or federal courts located in the State of New York, and both parties consent to the jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Shipping & Refund Policy (/shipping-refund-policy) and Privacy Policy (/privacy), constitute the entire agreement between you and Nattynooks LLC regarding your use of the Site and supersede any prior agreements.
